Terms of Service

You must be at least 18 years old and authorized to enter into binding agreements on behalf of your business to use the Service. By using the Service, you represent that you meet these requirements.

FoundMoney AI provides an AI-powered receptionist that answers incoming calls, qualifies leads, responds to inquiries, and books appointments directly into your connected calendar. The Service includes call handling, lead qualification, scheduling, SMS notifications, and reporting features. We may update, add, or remove features at any time.

You are responsible for:

• Maintaining the confidentiality of your account credentials;
• All activity that occurs under your account;
• Providing accurate and current business information, pricing, FAQs, and qualifying criteria used to train the AI;
• Keeping your calendar integrations connected and availability up to date;
• Complying with all applicable laws, including call-recording and telemarketing consent requirements in your jurisdiction.

You agree not to:

• Use the Service for any unlawful, fraudulent, or abusive purpose;
• Use the AI Receptionist to deceive callers about whether they are speaking to a human or an AI;
• Send spam, unsolicited marketing, or harassing communications through the Service;
• Record calls without obtaining required consent under applicable law;
• Reverse engineer, decompile, or attempt to extract the underlying AI models or proprietary technology;
• Resell or sublicense the Service without our written permission;
• Interfere with or disrupt the Service's servers, networks, or security.

The AI Receptionist uses conversational AI to handle calls and may not always produce perfect or complete responses. While we strive for accuracy, the AI may occasionally misunderstand a caller, provide incomplete information, or fail to book an appointment correctly. You are responsible for reviewing bookings and following up where appropriate. You acknowledge that the AI is not a substitute for professional judgment in complex or sensitive situations, and that we are not liable for missed, incorrect, or imperfect call outcomes.

The Service is offered on a subscription basis. Fees, billing cycles, and plan details are displayed at signup and may change with notice. You authorize us to charge your payment method for all recurring fees until you cancel. You may cancel at any time; cancellations take effect at the end of the current billing cycle and are not refunded except where required by law. Overages or usage-based charges, if any, will be billed as incurred. If a payment fails, we may suspend the Service until payment is resolved.

We may offer free trials or a satisfaction guarantee from time to time. Eligibility and terms for any trial or guarantee will be described at signup. Guarantees, where offered, apply only to the subscription fee and are subject to the conditions stated at the time of purchase.

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. You are responsible for ensuring you have the right to share any caller and calendar data you provide to the Service.

All rights, title, and interest in the Service, including the AI models, software, branding, and content, are owned by FoundMoney AI or its licensors. These Terms grant you a limited, revocable, non-exclusive license to use the Service for your business during your subscription. You retain ownership of the business information and content you provide to train the AI.

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, secure, or that every call will be handled perfectly. To the fullest extent permitted by law, we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

To the maximum extent permitted by law, FoundMoney AI and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of revenue, profits, data, or business, arising out of or related to the Service, even if advised of the possibility of such damages. Our total liability for any claim related to the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

You agree to indemnify and hold FoundMoney AI harmless from any claims, damages, or expenses arising from your use of the Service, your violation of these Terms, or your violation of any law or third-party rights, including call-recording consent obligations.

You may cancel your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, fail to pay fees, or present a risk to the Service or its users. Upon termination, your right to use the Service ends immediately. We may retain data as described in our Privacy Policy and as needed for legal compliance.

These Terms are governed by the laws of the jurisdiction in which FoundMoney AI is established, without regard to conflict-of-law principles. Any disputes will be resolved in the courts of that jurisdiction, unless we agree otherwise in writing.

We may modify these Terms at any time. When we do, we will update the "Last Updated" date and provide notice of material changes through the Service or by email. Your continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
